These Terms and Conditions apply to the Website (the “Site”), and form the basis of how we provide and supply our products and services to you. Please read the following Terms and Conditions before using the Site. Your use of the Site represents that you have acknowledged, understood, and agreed to the Terms and Conditions.

Accessing and Using The Site

By accessing or using the Site, you confirm that: 

  1. All information provided by you on the Site is accurate, current, and complete; and 
  2. You will not copy or distribute any part of the Site in any medium without The Happy Place’s prior written authorisation 
You shall be solely responsible for your access to and/or use of the Site and its materials herein. 

All information involved in site creation will be treated as private and confidential, and cannot be disclosed to third parties. We reserve the right to disable any user account at any time, should there be any situation where we deem that there is a non-compliance with our rules and regulations. 

Loyalty Programme

By creating an account with us, you agree to be part of our Loyalty Programme where you will earn points and redeem rewards through purchases made on the Site or at The Happy Place Product Showroom.
By participating in our Loyalty Programme, you agree to the following:

  1. Your account details are made known at the point of purchase for the rewards accreditation to take place.
  2. All accumulated spending and rewards are non-transferrable; they cannot be bought, sold or traded.
  3. Rewards cannot be used in conjunction with other promotions, offers, or discounts unless otherwise stated.
  4. We further reserve the right to change, modify (including how points will be earned and redeemed and what rewards will be available), terminate, discontinue or cancel the program at any time and in our sole discretion. Your continued participation in the program will confirm your acceptance of such changes or modifications. Therefore, you should review these terms and conditions and applicable policies frequently to understand the terms and conditions that apply to the program. 
  5. We also reserve the right to nullify any rewards that are deemed inappropriate or have breached any of the terms and conditions listed on this page.
The program terms and conditions, structures, FAQs, or any other descriptions of the program are subject to change at any time. Any changes, modifications, or termination of any part of the program or its terms will be effective upon publication of those changes on the Site. Your continued participation in the program will confirm your acceptance of such changes or modifications 


Redemption of Rewards

All rewards, including discount codes, vouchers, samples, and merchandise, are to be used before their specified expiry dates. No extensions will be granted. Before confirming your redemption, do carefully review the reward description, and terms & conditions. No refund of points will be granted once the redemption is confirmed.


Third Party Sites

The Site may contain third-party links which are not affiliated to, owned by or operated by The Happy Place, including but not limited to third-party payment hosting providers.
You acknowledge that The Happy Place, is not responsible for the content, privacy policies or practices of these third-party websites. By using the Site, you absolve The Happy Place, from any and all liability associated to your access and use of these third party websites. 

Intellectual Property Rights

The Happy Place is the sole owner and licensee of all intellectual property rights in and to the content of the Site. You may not copy, reproduce, distribute, publish, display, perform, modify, create derivative works, transmit, or in any way exploit any such content, nor may you distribute any part of this content over any network without prior permission obtained from The Happy Place.


Indemnities

You agree to indemnify us and hold us and our associated partners harmless from any claims, losses, and damages, including reasonable attorneys’ fees, arising out of:

  1. Your access to, use of, and/or participation in this Site;
  2. Breaches of your obligations under the T&Cs;
  3. Your violation of any rights of another person or entity;
  4. and/or Your breach of any statutory requirement, duty or law.

Returns

We will only offer an exchange or credit for purchases that were wrongly delivered to you, in terms of size (dimensions) or color, however, please help us to ensure the following: 
  • The item is returned within 14 days of purchase
  • The item is in its original condition and the packaging
  • The item is not damaged, used, or altered
*Purchase of sale items is final and cannot be returned or exchanged.
If you believe you have received the wrong item, at  hello@thehappyplace.sg with your order number, and a photograph of the item. 
If we accept your return, we will make a product exchange or offer store credits to you as soon as possible and generally within 30 (thirty) days from the day on which we receive the returned product. Should the situation arise where we find the item in less than satisfactory condition, The Happy Place, reserves the right to reject the return request at any point in time during this process.
   

Delivery

If we determine that our product was incorrectly delivered to you, our local delivery partner will retrieve the item from the address specified in your order. Please retain the original packaging and keep it intact to facilitate a seamless pickup process. We will notify you once our local delivery partner is prepared for the pickup.

The delivery timeframe will be communicated directly to you from our after-sale team Please note that the provided time frame serves as an estimate only.


Unsuccessful Pick-Up

In the event of an unsuccessful Pick-Up, we will contact you via WhatsApp or Email. However, you will be required to make necessary top-ups for a re-delivery to be arranged. The Happy Place reserves the right to terminate your order should there be repeated failures to take charge of the Pick Ups. No refunds will be provided for such cases.

Inventory

In the event we are unable to fulfill your order due to cancellation of backorder or inventory errors, orders will be refunded via e-gift card.


Gift Cards

Gift Cards are valid for a year, and are strictly non-refundable and non-extensible. Gift Cards can be redeemed over multiple transactions until its value has been fully utilized.


Store Credit

Store credit in your The Happy Place account can be redeemed towards the purchase of an item from our Site. Store credit expires after 2 years. Store credit is strictly non-refundable, non-extensible, and non-transferable.


Termination

We reserve the right, in our sole discretion, to restrict, suspend, or terminate this Agreement and your access to all or any part of the Site at any time and for any reason (including if we believe that you have engaged in any suspected fraudulent or abusive activity, or violated or acted inconsistently with the letter or spirit of this Agreement) without prior notice or liability, including the right to reject any order you place for the purchase of Products, which may result in the forfeiture and destruction of all information associated with your Account.

We reserve the right to change, suspend, or discontinue all or any part of the Services or the Content at any time without prior notice or liability. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, licenses of User Content, ownership provisions, warranty disclaimers, indemnity, limitations of liability, class action waivers, and arbitration.
